Any reference to "ULTRATREND FX CAPITAL LIMITED", "the Company", "we", "us", "our" refers to Ultratrend FX Capital Limited, a company duly incorporated and existing under the laws of Saint Lucia, bearing Registration Number 2024-00150, with its registered office located at Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia.

To the extent that any jurisdiction does not allow the exclusion or limitation of certain damages, the liability of ULTRATREND FX CAPITAL LIMITED shall be limited to the maximum extent permitted by applicable law.

This limitation of liability is an essential element of the agreement between you and ULTRATREND FX CAPITAL LIMITED, and the Site would not be provided without such limitations.

5. Governing Law and Dispute Resolution

These Terms and Conditions will be governed by, and construed in accordance with, the laws of Saint Lucia, without regard to its conflicts of law principles.

Any dispute, controversy, or claim arising out of, in connection with, or relating to these Terms, including the existence, validity, breach, or termination thereof, shall be exclusively resolved through binding arbitration, to be conducted in Saint Lucia, pursuant to the rules of International Chamber of Commerce or the Arbitration Act of Saint Lucia.

The parties agree that the arbitration shall be conducted by a sole arbitrator, and that the arbitration proceedings shall be held in the English language. The arbitration shall be the exclusive means of resolving any such disputes, and any award rendered by the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction.

By entering into this Agreement, you expressly consent to the exclusive jurisdiction and venue of such arbitration and waive any right to initiate or participate in any class action, collective action, or any other representative proceeding, whether in court or through arbitration.

Each party shall bear its own costs and expenses related to the arbitration, unless otherwise awarded by the arbitrator in accordance with the prevailing party rules.

6. Modifications to the Terms

ULTRATREND FX CAPITAL LIMITED ("the Company") reserves the right, at its sole discretion, to amend, modify, or update these Terms and Conditions ("Terms") at any time, without prior notice. Any such amendments, modifications, or updates shall become effective immediately upon being posted on the website or other online platform (the "Site").

It is your sole responsibility to periodically review these Terms to ensure that you are aware of any such modifications. Your continued access to, or use of, the Site after the posting of any changes to these Terms shall constitute your full acceptance of the revised Terms. If you do not agree to the modified Terms, you must cease using the Site immediately.

7. Miscellaneous

If any provision of these Terms and Conditions ("Terms") is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these Terms, and the remainder of the Terms shall remain in full force and effect, without being impaired or invalidated in any way.

The Company's rights under these Terms shall be cumulative and not exclusive of any rights or remedies provided by law or equity.
